Legal Rights of Consumers
Article 25 of China’s Regulation on Credit Reporting Industry provides that if believing the information collected, saved and provided by the credit reporting agency contains error or omission, a data subject has the right to file a dispute with the credit reporting agency or information provider for correction.

How to File a Dispute over Your Credit Report
If you believe the information in your credit report contains error or omission, you may file a dispute with the CCRC or its branch offices in person or by proxy.

I. File dispute in person
To file dispute in person, you shall provide your original valid ID document for verification, and fill in the Form of Application for Dispute over Consumer Credit Report and leave the duplicate of your valid ID document for our further reference.
The above-said valid ID documents include ID card (both sides to be copied for Generation II ID card), military officer ID card, solider ID card, passport, Mainland travel permit for Hong Kong, Macau and Taiwan residents and alien residence permit.

II. File dispute by proxy
If you ask another person to file dispute for you as proxy, the agent shall provide the originals of valid ID documents of you two and the Power of Attorney for verification, and fill in the Form of Application for Dispute over Consumer Credit Report with the duplicates of valid ID documents of both of you and the original of the Power of Attorney for our inspection.
You may also print and fill in the Form of Application for Dispute over Consumer Credit Report and the Power of Attorney.

IV. How does the CCRC respond to your dispute?
After accepting your dispute, we will get in touch with the commercial bank that has provided the information under dispute for inspection and will give you a response within 20 days after accepting your dispute. So, 20 days later, you can get your response at the branch offices of the PBC.

V. When filling in the Form of Application for Dispute over Consumer Credit Report, please note that:

i. You should fill in all the required fields as instructed.

ii. “Dispute description” shall specify:
1. Disputed Account. For example, in respect of a dispute over credit card account, the card issuer’s name, account type, account opening date and credit line should be described; in respect of a dispute over loan information, the lending institution’s name, loan type, lending date and loan contract amount should be described.

2. The data item that you deem with error.

iii. Your telephone number or mobile number should be filled correctly so that our customer service personnel can get in touch with you where necessary.

VI. Add Personal Statement into Credit Report
If you believe it is necessary to further explain the disputed information though you get a dispute resolution result, you may request to add a “Personal Statement” in your report. This personal statement should not include any content irrelevant to the information of your credit report and you should be responsible for the authenticity of your personal statement.

i. How to apply for adding personal statement?
When you request to add personal statement, you shall fill in the Form of Application for Personal Statement, provide the duplicate of your valid ID document and mail those materials to our Customer Service Department.

Recipient: Customer Service Department of the Credit Reference Center, the People’s Bank of China.

ii. When filling in the Form of Application for Personal Statement, please note that:
1. You should fill in your name, certificate type, certificate number and valid telephone number so that our customer service staff can get in touch with you where necessary.

2. “Statement description” should meet the following requirements:
(1) Specify the credit transaction involved in the personal statement. For example, to make a statement on credit card information, the card issuer’s name, card type, account opening date and credit line should be described; to make a statement on loans, the lender’s name, loan type, lending date and loan contract amount should be described.
(2) Describe actual situation about the credit transaction.
(3) Set forth your personal opinion. 
(4) The statement cannot have more than 100 Chinese characters (including punctuations).

3. You should sign your name and give the date of application.

4. The content of the personal statement cannot contain any sentences threatening others or entities or for complaints, such wording “ I’ll never apply for any credit card. If a bank issues credit card to me, I won’t take any responsibility for any or all of the consequences” will not be accepted.
